HOW TO ENTER: The #SmilingItForward ModernMom Twitter Party Sweepstakes (“Sweepstakes”) begins at 11:00:00 AM Pacific Time (“PT”) on November 5th, 2014 and ends at 12:00:00 PM PT on November 5th, 2014 (“Twitter Party”). The Pre-Party Sweepstakes (“Pre-party Sweepstakes”) begins 12:00 PM PT October 31st, 2014 and ends at 11:59AM PT on November 5th, 2014 (“Pre-party Sweepstakes Period).
To enter Sweepstakes, you must (a) have an active Twitter account and (b) RSVP to the Twitter Party via the ModernMom website (www.ModernMom.com). Limit one entry per person during Sweepstakes period and during the Twitter Party.
To enter Pre-Party Sweepstakes, you must (a) have an active Twitter account; (b) RSVP to the Twitter Party via the ModernMom website (www.ModernMom.com). Limit one entry per person during Pre-party Sweepstakes period.
Any entrant found to create or use multiple Twitter accounts to enter the Sweepstakes will be disqualified and ineligible. Sponsor’s decisions will be final in all matters relating to the Sweepstakes and winner eligibility. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, damaged, unintelligible or misdirected entries, all of which are void. Each potential Winner may be required to show proof of being the authorized individual account holder of the Twitter account associated with the winning entry in order to be awarded a Prize. By entering this Sweepstakes, you agree to the terms of these Official Rules and the decisions of the Sponsor, whose decisions shall be final and binding. Sponsor may at its sole discretion disqualify anyone who violates these Official Rules or undermines the integrity of the Sweepstakes.
ELIGIBILITY: The Sweepstakes is open to individuals 18 years of age or older as of date of entry who are legal residents of the 50 United States and the District of Columbia. Employees of Mom, Inc. (“Sponsor”), Johnson & Johnson (“Promotional Partner”), Zeno Group (“Agency Client”), and each of their respective affiliates, subsidiaries, dealers, distributors, retailers, advertising agencies, production agencies, electronic media firms, and their immediate family members and those living in the same household are not eligible to win.
PREPARTY PRIZES: Prizes: One (1) Amazon gift card valued at $50 US Dollars each.
TWITTER PARTY PRIZES: Prizes: Five (5) Amazon gift cards prizes available to be awarded: Five (5) gift cards valued at $50. Total ARV of all prizes combined: $300.00.
Winners will be responsible for any unspecified expenses and all applicable federal, state and local taxes. Prize is non-transferable and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of equal or greater value. Odds of winning depend upon the total number of participants. All Prizes will be awarded. No more than the advertised number of Prizes will be awarded. Limit of one Winner per household.
SELECTION OF WINNERS: Pre-party and Sweepstakes Winners will be determined using random.org on or around November 5, 2014 (from among all eligible entries submitted during the Sweepstakes Period for “Sweepstakes’ winners” and from the Pre-party Period for “Pre-party Sweepstakes winners) conducted by representatives of Sponsor, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning depend on the number of eligible entries received. Potential Winners will be notified on or about November 5, 2014 by Tweet from the Twitter account @ModernMom. Potential Winners must contact the Sponsor within two (2) calendar days of first notification or older or the prize will be forfeited and may be awarded to another eligible participant randomly selected by Sponsor. Upon prize forfeiture, no compensation will be given.
RELEASE OF LIABILITY: By participating, you release Sponsor, Promotional Partner, Twitter Inc. and their respective subsidiaries, affiliates, partners, employees, directors, and agents, including advertising agencies (“Released Entities”) from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and agree that the Released Entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
GENERAL RULES: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. No photocopied or mechanically reproduced entries are eligible. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsors, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the method of entry if it becomes corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select winner from among all eligible entries received at time of termination. Entry constitutes consent to the use of prize winner’s name, voice, picture and/or likeness without compensation for promotion purposes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE SWEEPSTAKES OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
