HOW TO ENTER: The #SmilingItForward ModernMom Twitter Party begins at 11:00:00 a.m. Pacific Time (“PT”) on November 5th, 2014 and ends at 12:00:00 p.m. PT on November 5th, 2014 (“Twitter Party”).
To enter the #SmilingItForward ModernMom Twitter Party Sweepstakes (“Sweepstakes”), you must (a) have an active Twitter account, (b) follow @ModernMom and (c) RSVP to the Twitter Party via the ModernMom website (www.ModernMom.com) by no later than 10:50 a.m. PT on 11/5/14. Limit one (1) entry per person/Twitter account. Multiple entries will be void.
Any entrant found creating or using multiple Twitter accounts to enter the Sweepstakes will be disqualified and all associated entries will be void. Use of any automated system to participate or subvert the entry process is prohibited and will result in disqualification and all associated entries will be void. Each potential winner may be required to show proof of being the authorized individual account holder of the Twitter account associated with the winning entry in order to be awarded a prize. By entering this Sweepstakes, you agree to the terms of these Official Rules and the decisions of the Sponsor, whose decisions shall be final and binding. Sponsor may, at its sole discretion, disqualify anyone who violates these Official Rules or undermines the integrity of the Sweepstakes or acts in a disruptive or unsportsmanlike manner.
ELIGIBILITY: The Sweepstakes is open to individuals, 18 years of age or older as of date of entry, who are legal residents of the 50 United States and the District of Columbia. Employees of Mom, Inc. (“Sponsor”), McNeil Consumer Healthcare Division of McNeil-PPC, Inc. (“Promotional Partner”), Zeno Group (“Agency Client”), and each of their respective parents, affiliates, subsidiaries, distributors, retailers, advertising, promotion and production agencies, electronic media firms, and all of their immediate family members (spouses, parents, children, siblings and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to enter or win.
PRIZES (6): $50 Amazon gift card. Approximate Retail Value (“ARV”): $50 each. Total ARV of all prizes: $300.00. Gift cards are subject to terms and conditions specified by Amazon.com.
Winners will be responsible for any costs and expenses associated with prize acceptance and use not specified here as being provided and all applicable federal, state and local taxes, if any. Prizes are non-transferable and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of comparable or greater value, at its sole discretion. Odds of winning depend upon the total number of eligible entries received. All prize details are at Sponsor’s sole discretion. Limit of one (1) prize per household.
SELECTION OF WINNERS: On November 5, 2014, beginning at or around approximately 10:55 a.m. PT and approximately every 10 minutes thereafter, Sponsor will randomly select one (1) potential winner from among all eligible entries received. Potential winners will be notified immediately following the drawing during the Twitter Party by a @mention from @ModernMom. Potential winners must contact the Sponsor within two (2) calendar days of date of first notification or older or the prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate winner. Upon prize forfeiture, no compensation will be given.
PUBLICITY GRANT: By participating, each entrant, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, username, address (city and state), photograph, voice and/or likeness (including, but not limited to, profile photo) for advertising, trade and promotional purposes, in any and all media now known or hereafter discovered, worldwide in perpetuity, in any manner, without further notice, review, approval or compensation.
RELEASE OF LIABILITY: By participating, you release Sponsor, Promotional Partner, Twitter Inc. and their respective parents, subsidiaries, affiliates, partners, distributors, retailers, advertising, promotion and production agencies, electronic media firms and all of their respective employees, officers, directors, representatives and agents (collectively, “Released Entities”) from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and agree that the Released Entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, you agree that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event will you be entitled to receive attorneys’ fees or other legal costs; and (iii) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
GENERAL RULES: Released Entities are not responsible for: (i) lost, late, incomplete, invalid, damaged, delayed, inaccurate, unintelligible or misdirected entries or Tweets; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; (iii) or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials; or (iv) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these or any other official rules or who acts in a disruptive or unsportsmanlike manner and void all associated entries. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winners from all non-suspect, eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. In the event of a dispute regarding game plays received from multiple users having the same Twitter account, the authorized subscriber of the Twitter account at the time of entry will be deemed to be the participant and must comply with these Official Rules. The authorized account subscriber is the natural person who is assigned the Twitter account by the social media platform. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE SWEEPSTAKES OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES, AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL, TO THE FULLEST EXTENT PERMITTED BY LAW.
